1.1. Our Purpose
Our services provide our Users (defined below) with the ability to easily create a functional and striking online presence, manage and promote their businesses, content, and ideas, and have an exceptional experience in the process, even with little knowledge of technology or design. As described below, we offer various tools and resources to our users so they can create, publish, and use impressive websites, online e-commerce platforms, newsletters, galleries, video players, apps, and other online and mobile services and tools. The functionalities, websites, and online and mobile platforms created by Users are collectively referred to in this document as "User Platforms."
AutoSite360 offers online and mobile services and tools that allow the User to create, manage, and/or use their own online and mobile presence.
1.2. Legal Agreement
These AutoSite360 Terms of Use ("Terms of Use"), together with additional terms applicable to certain services and features of ours (as indicated on the AutoSite360 website) (hereinafter referred to as the "AutoSite360 Site" and collectively "AutoSite360 Terms"), comprise all the terms and conditions governing each visitor or User (hereinafter referred to as "User" or "you") of the AutoSite360 Site, the AutoSite360 mobile application (the "AutoSite360 App"), and/or any other service, application, or feature offered by AutoSite360 related to these, except as otherwise provided by AutoSite360 (all services made available through the AutoSite360 Site or the AutoSite360 App, collectively referred to as "AutoSite360 Services" or simply "Services"). For clarity, the AutoSite360 Services (as defined in these Terms of Use) do not include services, applications, features, or components created, developed, connected, or offered by an AutoSite360 User, even if presented on the AutoSite360 Site or the AutoSite360 App.
The AutoSite360 Terms constitute a binding and valid contract between the company AutoSite360 Ltda. and its affiliates and subsidiaries worldwide ("AutoSite360" or "we") and you regarding the use of any AutoSite360 Services. Therefore, please read them carefully.
You may visit and/or use the AutoSite360 Services and/or the AutoSite360 App only if you fully agree with the AutoSite360 Terms, and by using and/or registering for any AutoSite360 Services, you declare that you affirmatively and knowingly consent to these Terms of Use and to any other applicable AutoSite360 Terms for your use of AutoSite360 Services. If you have not read, fully understood, or do not agree with the AutoSite360 Terms, you must immediately exit the AutoSite360 Site and avoid or cease any use of AutoSite360 Services or the AutoSite360 App.
By using our services, you also acknowledge having read our Privacy Policy, available in our Privacy Policy.
By visiting our site or using our apps and/or services, you are entering into a legal contract with us, composed of these Terms of Use and our additional legal terms for service provision.
By using our services, you agree to these terms and acknowledge having read our Privacy Policy. If you do not agree with all of our terms, you may not use our services.
1.3. User Account
To access and use certain sections and features of the AutoSite360 Services, you must first register and create an account on AutoSite360 ("User Account").
Creating a User Account or purchasing Paid Services (as defined in Section 5 below) can be done directly through the AutoSite360 Site or through authorized third parties selling AutoSite360 subscriptions for User Accounts and other Paid Services ("Reseller") under a separate agreement with AutoSite360 ("Reseller Agreement").
If you register with the AutoSite360 Services or purchase Paid Services through a Reseller (hereinafter referred to as "Reseller User"), consider the following:
These Terms of Use are applicable in addition to any agreements between you and the Reseller and govern your use of the AutoSite360 Services.
With regard to the agreement between you and AutoSite360, for your relationship with AutoSite360 and unless otherwise stated by AutoSite360, you will be considered a User, not a Reseller User.
Your Reseller is not an agent of AutoSite360, has no authority to make statements, representations, or commitments on behalf of AutoSite360, and cannot bind AutoSite360 in any way.
The payment you make to your Reseller is considered a payment made by you directly to AutoSite360.
AutoSite360 is not obligated to provide any kind of support to you, a Reseller User. Support, if available, will be provided to you at the sole discretion of AutoSite360.
1.4. Use by Minors
The AutoSite360 Services are not intended for individuals under 13 years of age. If you are under 13 years old, you may not register a User Account or provide any personally identifiable information through the AutoSite360 Services. If you are between 13 and 17 years old, you may only use the AutoSite360 Services and provide personally identifiable information provided your parent/guardian reads and agrees to these Terms of Use on your behalf. Any access or use of the AutoSite360 Services by individuals under 13 years of age without appropriate consent is strictly prohibited and in violation of these Terms of Use.
1.5. Updates to AutoSite360 Terms
AutoSite360 reserves the right, at its sole discretion, to change, modify, add, or remove any portions of the AutoSite360 Terms at any time, without prior notice. We recommend that you periodically review the AutoSite360 Terms to be aware of changes. Your continued use of the AutoSite360 Services after the posting of any changes to the AutoSite360 Terms will signify that you have accepted such changes. If you do not agree with the amended AutoSite360 Terms, you should discontinue your use of the AutoSite360 Services.
